The Below Guidelines and Terms of Service, can and do change without notice. You are responsible for visiting this page often to stay informed of any changes which may occur. Members who are in violation of these policies will have their membership revoked and their pages removed without warning.

Introduction

The purpose of the SwingClub's Free Homepage Program is to give swingers the ability to create a home on the World Wide Web that reflects their interests, hobbies and points of view, and to allow people to communicate their thoughts and ideas with others. SwingClub.NET is an amazing place. The websites created by members of SwingClub.NET contain an incredible array of facts, opinions, entertainment and interesting information. We are mindful of our role as stewards of these communities and will do our best to ensure that SwingClub.NET remains a positive contributor to the Internet. SwingClub.NET is committed to providing a forum for diverse points of view. We have established the guidelines and terms of service that follow to help our members achieve a true sense of community. If you disagree with some of the opinions or kinks expressed by a member of our community, we encourage you to create your own free HomePage and make your views known. To us, this exchange of ideas is the definition of community. We appreciate your interest in and support of SwingClub.NET, and we pledge our continued support in building the societies of the new frontier.

Moving In

We, at SwingClub.NET have had to revise this policy, due to some members registering a site, and not moving in. This causes names to be frozen, that could be used by others, who will add to the community.

  • Members must place valid content on their site within 7 days of registration, or the site will be deleted. NO "UNDER CONSTRUCTION" SITES ARE ALLOWED FOR MORE THAN (seven) 7 DAYS. These lower the value of the community for everyone.

Content Guidelines

SwingClub.NET has carefully developed the following content guidelines to promote the free flowing exchange of ideas about your interests, activities and hobbies, while maintaining standards consistent with the Internet community. Please refrain from using vulgar slang on your pages. When referring to body parts, use the proper terms, rather than street slang. SwingClub.NET does not discriminate based on sex, age, gender, sexual orientation, ethnicity, culture, religion or socio-economic status. Please refrain from using your Personal Page for the following activities:

  1. Pornographic material. This is a site for people in the Swing Community. If your site has anything to do with pornographic material, it will be deleted.

  2. Sites whose sole purpose is "click-through" to another site. i.e.; Picture galleries loaded with banners, or text links, will be deleted without notice. DON'T EVEN ASK WHY.

  3. Links to Bianca's BBS. No links from any site within the SwingClub.NET domain to Bianca, BBS. We do not agree with the practices of this Bianca's BBS and will not allow any site within our domain to add to their business.

  4. Displaying material containing beastiality, pediaphelia, non-consensual acts, and any/all pornographic material of any kind. Pornographic material is defined as any depiction of a sexual act, either real or simulated, as well as, any material which has no redeeming literary, artistic, social or educational value and is also considered that which  appeals primarily to the prurient interest. This may be expanded from country to country or state to state, please be advised of your local community standards and those of the United States;

  5. Providing material that is grossly offensive to the swing community, including blatant expressions of bigotry, prejudice, racism, hatred or excessive profanity;

  6. Displaying material that exploits children under 18 years of age in any way;

  7. Promoting or providing instructional information about  non-consensual acts, illegal activities, promoting physical harm or injury against any group or individual, or promoting any act of cruelty to animals; This includes, but is not limited to, the following activities: Providing instructions on how to assemble bombs, grenades and other weapons; Disseminating personal information about another individual for malevolent purposes; Creating "Kill"  or "Hurt" sites; Providing computer software viruses or software designed to create a virus; Providing satellite TV cracks; Providing programs to "nuke" or create a denial of service attack against another individual or ISP; Facilitating the delivery of "spam" e-mail; Soliciting passwords from other members.

  8. Committing acts of copyright, trademark, patent, trade secret or other intellectual property infringement; This includes, but is not limited to, the following activities: Providing pirated computer programs or links to such programs or links to sites with such programs; Providing information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs; Providing any type of crack utility; Providing pirated music or links to such files.

  9. Defaming any person or group of people;

  10. Developing restricted or password-only access pages, or hidden pages or images (those not linked to from another accessible page);

  11. Using your home page (or directory) as storage for remote loading or as a door or signpost to another home page, whether inside or beyond SwingClub.NET; (you may link to another site, but you must have at least two pages of content on your SwingClub.NET site.) All of the links on the first two pages must link to pages within SwingClub.NET

  12. Developing home pages or session posts that consist of hyperlinks to content not allowed in SwingClub.NET;

  13. Having multiple SwingClub.NET addresses that have the same theme; Each SwingClub.NET address allows that particular individual to have 2MB of disk space for his or her files;

  14. Using SwingClub.NET for the purpose of gathering personal identifying information from individuals for commercial or unlawful purposes;

  15. Posting or disclosing any personal identifying information belonging to children;

  16. Violating Internet standards for the purpose of promoting your home page;

  17. Conducting raffles or contests that require any type of entry fee, unless approved by us, in writing, before the pages are posted;

  18. Promoting, soliciting or participating in multilevel marketing or pyramid schemes.

We reserve the right to remove any page from the system which is brought to our attention and which we find, in our sole discretion, violates any of these page content guidelines or otherwise is in violation of the law.

SwingClub.NET does not actively monitor the content of Personal Pages, but we do surf through them and we will investigate complaints of violation of these guidelines. Please submit any such complaints to:

Members who are in violation of the SwingClub.NET Content Guidelines or Terms of Service may have their membership revoked, services cancelled and their pages, removed without warning, in which event SwingClub.NET will not return the removed pages or website to the offending member. SwingClub.NET is not responsible or liable for any loss of data resulting from our deletion of pages and/or directories, network or system outages, file corruption or any other reasons. We urge all members to maintain backup versions of their home pages to guard against losses of any kind.

Member E-Mail Guidelines (for those with e-mail access)

SwingClub.NET encourages you to use your member e-mail account as often as you like. Always remember to stay within the accepted use policies that govern e-mail, and do not use it for the purpose of "spamming" newsgroups, individuals or companies, conducting unwanted solicitations of groups or individuals, harassing or threatening anyone, or for the purpose of conducting illegal activities. Sending "spam" e-mail through the SwingClub.NET systems or using any SwingClub.NET trademark in connection with sending "spam" e-mail is a serious violation of Netiquette as well as a violation of applicable laws. SwingClub.NET will take the appropriate legal action under the circumstances, which may involve referring the matter for criminal prosecution.

SwingClub.NET Membership Terms of Service

  1. SwingClub.NET Personal Pages accounts are available to persons 21 years of age or older. SwingClub.NET reserves the right to deny, suspend, or revoke any membership (without prior notice) in the event that SwingClub.NET learns or has reason to believe, that a member or person seeking membership is under the age of 21.

  2. The opinions and views expressed in the Personal Pages do not reflect those of SwingClub.NET. The contents of the Personal Pages are not reviewed in any way, other than checked for our link, before they appear in SwingClub.NET.

  3. SwingClub.NET is not responsible for the content of any Personal Home Page. Members are solely responsible for everything contained in their own Personal Home Pages. SwingClub.NET does not verify, endorse or otherwise vouch for the contents of any Personal Home Page. Members may be held legally liable for the contents of their Personal HomePages and may be held legally accountable if their home pages include, for example, defamatory comments or material protected by copyright, trademark, patent or trade secret law without the express permission of the author or owner.

  4. SwingClub.NET is not responsible for the delivery of any goods or services sold or advertised through its sponsors, or its members' commercial home pages.

  5. SwingClub.NET does not actively monitor the content of Personal HomePages but we do surf through some of the pages, and will investigate complaints of a violation of the SwingClub.NET Content Guidelines and Terms of Service. Please submit any such complaints by sending email to: ABUSE@SwingClub.NET

  6. The member agrees to indemnify and hold harmless SwingClub.NET, it's employees and assignees for any loss, liability, claim, damage, and expenses (including reasonable attorneys' fees) arising from or in connection with the contents of the member's home page or use of the member's SwingClub.NET account.

SwingClub.NET is not responsible or liable for any loss of data, nor is it required to return any data, resulting from our suspension or deletion of pages, directories or subdomains, network or system outages, file corruption or any other reasons. We urge all members to maintain backup versions of their home pages to guard against losses of any kind.

Page Content Requirements:

  1. Members must place valid acceptable content on their site within 7 days of registration.

  2. No 100% frames, leading to other sites, will be allowed.

  3. The first three pages of your site, must be located on SwingClub.NET

  4. Due to the nature of the majority of pages, on this site, providing false or misleading information, on your signup form, will be cause for immediate termination of your account, without notice.

  5. There must be NO attempt to hide or obstruct our links at the top and bottom of the pages! (This includes multiple breaks at the end of your page or other deceptive practices)

  6. Any sites found abusing SwingClub.NET Free Hosting service will be terminated immediately, without notice. (This includes massive posting to TGP's and Picture Post  Sites or Hotlinking of any kind) Do NOT submit your site to the huge TGP sites!!!!! They do nothing but gobble bandwidth and very few people have the experience to use this traffic productively.

Communication

All communication with the staff of SwingClub.NET, either in e-mail, postal mail, telephone or any other means, is to be done with respect, just as we will attempt to show you. Any use of foul language, harassment, abusive tone, or other tactics meant to harrass the staff, will result in your account being cancelled.

Intellectual Property Dispute Policy

In the event that SwingClub.NET receives a complaint that the content of a Personal HomePage allegedly infringes intellectual property rights or is otherwise unlawful, SwingClub.NET may request written substantiation of the complaint from the complaining party, for example, substantiation of proof of ownership in the form of a trademark, service mark, patent or copyright. SwingClub.NET will take the steps it believes to be appropriate under the circumstances, including, for example: 1.Suspending the site, or a portion of the site, immediately until the dispute is resolved; 2.Providing the member with contact information for the complaining party; 3.Instructing the member to contact the complaining party to resolve the dispute; 4.Informing the complaining party of our actions and ask that party to work directly with the member; Note: All correspondence between the parties must also be sent to SwingClub.NET (address provided); 5.Taking the following action based on the progress of the dispute: If the member has not pursued resolution within 14 days of a notification, the site, or portions of the site, will be deleted; If the complaining party has not pursued resolution within 14 days of the member's response, the site, or portions of the site, will be re-activated; If legal action is pending or the dispute is not settled, the site, or portions of the site, may remain suspended until resolution is reached and SwingClub.NET is notified by both parties as to the outcome; If a resolution is reached between the parties, the site, or portions of the site, will be re-activated with any mutually agreed upon modifications. If a copyright, trademark, patent, or other infringement is obvious (such as when pirated computer programs or information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs or any type of cracker utility, is being distributed), SwingClub.NET also reserves the right, instead of following the above stated procedures, to delete all files and remove the account holder without any warning. Other Rights Reserved SwingClub.NET also reserves the following rights: To amend or change the SwingClub.NET Content Guidelines or Terms of Service at any time and without notice; To release current or past member information if SwingClub.NET believes that a member's account is in violation of the SwingClub.NET Content Guidelines or Terms of Service, is being used to commit unlawful acts, if the information is subpoenaed and/or if SwingClub.NET deems it necessary and/or appropriate; To deny membership to serious or repeat offenders of the SwingClub.NET Content Guidelines or Terms of Service; To remove members for conduct that SwingClub.NET believes is harmful to other members, to non-members or to SwingClub.NET as a business; To remove members who interfere with the design and operation of the "link code" at the tops of pages, SwingClub.NET devices, without warning; To utilize third parties to provide services to SwingClub.NET members. These third parties may require limited access to members' personal identifying information in order to perform the services. Notice will be given to members of the need to share information at the point of collection or a reasonable amount of time before sharing begins; To use images of account holder pages for promotional and other commercial purposes.
